It would have been nice if people would sue Iowa when their CBD is taken, because the products will be returned from what I used to understand. Now, we don’t know, because everybody chickened out. One business owner who claimed she was going to fight the police got frustrated and decided to fight WeedPress for no reason instead, which has been completely ineffective.
When it comes to Dubuque Police, they are wrong. Ames had a sergeant I personally called, who had your local drug task force (fire them all, bad drug policy from wrong science has failed, try again) investigate CBD products and clear them as legal. To prove the falseness of the Dubuque Police claims, CBD is sold within a five minute walk right here in Ames from where I’m typing this! So, the cops want to use the power of authority, and people’s gullibility and lack of critical thinking, to try and scare Iowans from what appears to be legal products (as long as not even a trace of THC that will show up in lab tests under Iowa law.)
CBD is unregulated in Iowa. Until someone sues, the cops will continue these grandstanding Facebook posts.

Update one: We definitely have a state problem. Ames Police advise to contact State Attorney General’s office. Our position has changed and we disagree with Ames PD and Central Iowa Drug Task Force assertion that Iowa law allows CBD sales and advise not to possess or own if you think CBD is illegal. I’m ok with possessing it myself for what it’s worth as I personally believe it is legal but our lawyers at the organizational advise erring on the side of caution, so we are taking the following position until Iowa AG’s office replies to a complaint filed about a month ago by us.
Position statement: This position statement from IDPH, while authoritative, has somehow lead to differing conclusions amongst law enforcement agencies, specifically, Denison and Ames PD believe these products legal AT THIS POINT IN TIME — this is subject to change without notice. Dubuque and Muscatine PD believe these products are not legal AT THIS POINT IN TIME — this is subject to change without notice.
Position statement from IDPH as of August 2018, the correct position, here: https://pharmacy.iowa.gov/sites/default/files/documents/2018/08/idph_position_statement_on_cbd_-_08-2018.pdf?fbclid=IwAR0KYsZcjjlSCSgBhJYJ6tU8ezI4i2R5Nba3KZtZcg1jnTVYdiu4MxwqPNo
All organizations in Iowa that we are aware of agree with this position statement at this point in time. Will update here on WeedPress as this progresses until resolved.

Update two: Inquiries into Ames PD were handled like the 30 or so inquiries we handled last year. Doing our best to standardize issues of contention to reduce the discourse to it’s most elemental and fundamental points of divergence so as to resolve perspectives erroneously based on partial or incorrect developing information as we move forward with critical legal issues and principles surrounding federal and state law, all of which can and will be answered, here, at WeedPress.WORDPRESS.com.
Here’s my first of three conversations today where I was told I would be arrested if I went anywhere in Ames, like to Wheatsfield Health, and purchased CBD to be tested at the PD to confirm there was never any THC in these products (more on the importance of that in later updates).
************************************************************************************
Update 2: It’s 9:20 PM Wednesday evening when this first came to my awareness (the Dubuque claims) and our updated legal policy. Spent an hour and a half on the phone discussing this situation and decided to save two more updates that happened today until we get our third update tomorrow so we know how to even explain the first two but essentially, the hysteric yelling and screaming about this situation is just that, unnecessary hysteria. Also the cops are allegedly trying to play politics instead of calmly adjudicating the law on the eastern end of Iowa.
I also spent 45 minutes on the phone with the U of I.
*************************************************************************************
Update 3: I’ve repeatedly said I don’t know what’s going on and am not a lawyer. It looks like this guy thinks I should go to jail to protect him, which I disagree with. If I misinterpreted his statements I’ll clarify what he meant but for now this is one of the problems: the law isn’t clear to everyone, and even when the police tell people the products are legal, they’ve been confiscated in Carroll, Muscatine and Dubuque right now, and none of these people deserve to be criminals.
If your a cannabis activist you would have met the officer at the smoke shop like they wanted you to, but you didn’t. You didn’t purchase anything from the smoke shop and have the Ames police department test it for THC because you didn’t want to take the chance of being arrested, some activist you are. Why would you even call the police department, cannabidiol has medical properties and trump signing the hemp farm bill made cbd legal, as long as it’s derived from hemp.
You are being part of the problem?
Why call the cops?

Iowa Patients for Medical Marijuana Josh Gowdy Great questions. If you can’t figure it out, I unfortunately cannot help you. Get a good lawyer if you’re worried about snitches. If you’re not breaking the law with this, the police in Ames told me the police who confiscated the Corner Store Apothecary & More were wrong to do so, and that we need to involve the Office of the Attorney General of Iowa. Thanks for the inquiries, you can follow me when I purchase the products at the shop as I have repeatedly said I would. The person flashing the cash is indeed a snitch in a court case against me, that is not me, but thank you for your legitimate concerns about violent criminal behavior, all shall be revealed, keep the questions coming please.

Iowa Patients for Medical Marijuana I was advised by legal council to call the cops to make sure I don’t get arrested when I go to the shop. If the phone call here doesn’t make that clear, I’ll clarify in the morning in the promised updates.
Those really are legitimate questions, to a point, and again if this isn’t obvious then ask a lawyer. I’m not giving legal advice, but have found authoritative and legitimate parties advising getting the state law enforcement together, so I’m going to do that as long as it isn’t illegal. That’s what changing laws can sometimes entail — getting things right, instead of letting them stay so very very wrong.

Iowa Patients for Medical Marijuana Otherwise, go tell it to the judge. Good evening.
Iowa Patients for Medical Marijuana I private messaged you with an invitation to accompany me to the police station tomorrow.
You don’t have to respond. I’m only concerned with what the lawyers say, not people who can’t afford to protect their patients while urging others to go to jail for them.

Update 4: 11:39 PM, Federal IND patient and long time activist I had the sincere pleasure of dining and listening in on forty years of humble activism and courageous, truly awesome presence in court and on the stage, former Vice President of the United States candidate Mr. George McMahon has joined the discourse:

I’m excited because it sounds like my questions and confusions over why Iowans are getting hurt for no damn reason are actually going to get answered by the state without any more undue hardship, which is a relief. I’d like to buy these products now that I’m back in school until I get added to the medical program, which will take at least six months which means I won’t have access to what I need to pass my classes as well, which is just not ok. We need the law unambiguous here where presently it is clearly not.

I called the cops to ask if I went to the shop to do this if I would get arrested and they said yes. If you would like to prove to me this isn’t a problem, please submit a sample of this to the Ames PD so they can prove to everyone else these products are legal by returning them following drug testing. This may be completely over your head but that’s the only solution to your concern about my alleged lack of willingness to go to jail without any good reason. Why should I go to jail for you Josh?
The state has given this official notice. How am I misinterpreting the statement that these products may not be legal like Dubuque Police Department stated on their Facebook in November?
I don’t think you understand what is happening here, which puts us in the same boat. I’m not a lawyer. I’m just asking these questions and shall get clear and concise answers.

Because of a law? One created and endorsed by an American “Hitler” of his time? One that took off like wildfire by the corrupt, the racist, and the money hungry? One that fills our prison systems with non-violent people, minorities, and otherwise intelligent and productive human beings had they not been criminalized over the fear of a plant? This is a law I will never respect.

You can get Hemp derived CBD oil and supplements that contain less than .03% THC and those supplements are legal.
There is a difference…

A Rutherford County judge ordered 23 stores in the county to be padlocked for selling candy laced with CBD. The grand jury indicted 21 people for selling the products.

Ian Lambach “Over the last five years, Dubuque experienced one of the largest increases in violent crime of any city. The incidence of violent crime in the metro area rose by 56.5%.”
Dubuque PD, I really mean this: Aren’t you deeply embarrassed by your inability to do real police work?

Carla Kaufman Actually, the CBD oil from the medical dispensaries will have 3% THC https://www.google.com/…/amp…/amp/1850109002

AND~ 30 day, empty bottle money back guarantee‼️People really need to get educated.

Don’t waste your time investigating CBD Oil.

Whitney Kelleher This is the kinda bull excuse that Dubuque wants to pull to excuse pissing away time and money on something that that is not dangerous and people use for medical reasons. Meanwhile opioids and other real drugs run rampant on the streets but noooooo we gotta waste everyone’s time on this load of horse crap.
Not only that but it’s not even all true.
Oh wait, it’s already legal there.
🤦♂️
