IDPH Position Statement on CBD Products in Iowa

Legal Medical CBD Products.

Medical cannabidiol (CBD) products are now available for purchase by Iowa patients and primary caregivers who hold a medical CBD registration card issued by the Department of Public Health (Department). Medical CBD products can be purchased at the following five dispensary locations:

Sioux City –MedPharm Iowa, 5700 Sunnybrook Drive

Council Bluffs –Have A Heart Compassionate Care, 3615 9th Avenue

Des Moines/Windsor Heights –MedPharm Iowa, 7229 Apple Valley Drive

Waterloo –Iowa Cannabis Company –1955 La Porte Road

Davenport –Have A Heart Compassionate Care, 222 E. 53rd Street

Medical CBD products may be legally manufactured in Iowa only by the two companies which hold Iowa manufacturer licenses: MedPharm and Iowa Relief. Medical CBD products may be legally dispensed in Iowa only by the five companies which hold Iowa dispensary licenses at the locations above. Patients and primary caregivers are protected from criminal prosecution for the possession of marijuana if they (1) possess a valid medical CBD registration card issued by the Department, (2) purchase and possess medical CBD products from an Iowa licensed dispensary, and (3) use medical CBD products as authorized under the Medical CBD Act (Iowa Code chapter 124E). Other CBD Products.

The Department is not authorized under Iowa Code chapter 124E to regulate the sale or use of other types of CBD products that may be currently available at retailers throughout the state or through online sales. Iowans who dispense, sell, possess, or consume such products should be aware that those CBD products have not been approved under either a federal or state of Iowa regulatory program. This means the content, quality, and safety of those products has not been regulated by a federal or state of Iowa agency. Additionally, Iowans who dispense, sell, possess, or use such products are not protected from criminal prosecution as the protections from criminal prosecution contained in chapter 124E do not extend to the dispensing, possession, or use of these types of CBD products. Agencies with enforcement authority in this area include the federal Drug Enforcement Administration, the federal Food and Drug Administration, county attorneys and law enforcement agencies.

FDA-Approved Medications.
Iowa’s medical CBD law does not apply to the possession or use of the following products, and Iowans may continue to use the following products if appropriately prescribed:

1.Appropriately prescribed, FDA-approved drugs: Marinol, Syndros, Cesamet, Epidiolex
2.Sativex, produced by GW Pharmaceuticals, as part of a FDA-approved clinical trial
