A somewhat concerning email sent late last week to Iowa DHS employees around Iowa appears to instruct workers to remove children from homes using over the counter CBD not purchased at state licensed dispensaries this past week.
CBD has been extremely popular among consumers in Iowa the past two years, despite it’s illegality, and recent emails from January 17 show the State of Iowa is no longer turning a blind eye.
The sole concern from an advocacy perspective here is, there Iowans who mistakenly either think CBD is legal, or worse, think that breaking the law by using CBD is not going to put them at risk for legal trouble. Without the cannabis community educating these Iowans, parents are not going to know about DHS taking their children away in the event an unscrupulous neighbor turns them into the state for using CBD without a medical card.
These emails below should be shown to caution anyone selling or using CBD in Iowa.
If the parents have a legally approved state medical cannabis card, and also purchase their CBD products through the state dispensaries, they are legally protected. DHS is not going to come after you. If you buy from the Corner Store Apothecary in Cedar Rapids, or any other illegal CBD “business,” and get charged with child abuse, ask your salesperson at the counter before you leave why they prefer to continuously and intentionally endanger your life than work to change the law and protect Iowans safety. Such negligence shows severe lack of character and honesty. Selling products that endanger people’s freedom while telling them there’s nothing to worry about blows my mind.

Emails obtained by WeedPress show DHS emailing state employees about illegal CBD complaints.

It was not clear to state employees who work at DHS whether or not these emails included state authorized CBD oil obtained with a medical cannabis card from state authorized dispensaries. The Office of Medical Cannabidiol assures Iowans that there is no reason to think DHS will investigate legal CBD users, only illegal CBD. DHS is only looking for documentation for state authorized patients.

Iowa Code allows for removal of a child with the approval of a judge for illegal CBD.
Again, there is no need for Iowans to worry if they are following state law.
Update: Kymm Loeffler, illegal CBD store owner of the Corner Store Apothecary in Sioux City, commented on this article. I’ll share her viewpoint below. Kymm, it should be noted, is both not a lawyer, and, wrong, on the law here. CBD is illegal. It’s not my fault, but Kymm has repeatedly yelled at advocates for pointing out that the law is the law, and it matters. She even tries to accuse me of being a law enforcer here. What a nasty woman.
Kymm High-Loeffler The writer of this article is uneducated on the laws. CBD is not illegal, that is the Iowa Public Health opinion. It is not law. The law said it is up to each individual county to establish their own guidelines for arrests and prosecution, while federally legal in all 50 states. Have you actually read the law? All the articles and news on the “illegal CBD” confiscations have been used as scare tactics to hide the real truth. The media doesn’t tell you what happens after these arrests… nothing… they can not prosecute these people. At Corner Store Apothecary& More, we are educators. We educate the community on cannabis and all natural products. People should have the right to purchase an all natural product, without fear of being harassed or by slander by uneducated people. Splenda “Stevia” has a wonderful commercial about their natural plant product. I suggest you watch the commercial and then write an article to slander SPLENDA, if make you feel better. It seems as if you are trying to be a law enforcer without all the facts. As for the state of Iowa and the Iowa Public Health Department, they are very well aware of our store and education process, and they certainly don’t have a problem accepting all the sales tax/revenue we file every year with them.
