I have a state medical cannabis card, but am on federal probation. This creates a problem for me. I see in the US code that there is a process to apply to the federal government asking for an exemption from federal law for state programs. Can you help me apply for federal exemption with the law? Otherwise, what are you doing to protect state authorized patients like me from federal law, when federal law is telling state authorized patients like me that federal law overrules my state medical card?

Again, due to my probation requirements, I can go to jail for using state authorized medical marijuana, but there is a way to resolve this issue by applying for federal exemption.

When dealing with the South Dakota Department of health, point out 21 USC 821(d), exemption for manufacturers and distributors, and ask, “what did you set up in SD? Manufacturing and distributing! What did we set up in SD? Manufacturing and distributing! Are we going to repeal state law, or apply for exemption? I think we should apply for exemption.” This way, it’s an appeal to doing things a better way. Then, the whole thing has shifted. Let’s make the DEA responsible for this, not the state. But — somebody will sure as hell, be held responsible. Appeal to their professional integrity and pride in doing a good job. These are professionals and not everyday people. If you know how to drive a rivet well you take pride in it and if you know how to file legal things well you take pride in filing and doing legal things well.
