Subject: Formal Complaint Against Dane County Circuit Court Judge Ellen Berz for Judicial Misconduct, Religious Discrimination, and Systematic Violations of Constitutional Rights

Dear Members of the Wisconsin Judicial Commission and Concerned Parties,

I am writing to formally request an investigation into the conduct of Dane County Circuit Court The Dishonorable Judge Ellen Berz, pursuant to Wisconsin Statutes § 757.81-757.99 and the Code of Judicial Conduct (Supreme Court Rule 60). In my capacity as an investigator and expert witness for the Lion of Judah House of Rastafari Church case involving Ras Jesse Schworck, I have uncovered a preponderance of evidence and multiple credible reports suggesting that Judge Berz’s actions constitute judicial misconduct, including violations of impartiality, diligence, and the decorum expected of a judicial officer. Below, I outline the specific incidents and patterns of behavior that substantiate this complaint.

Allegations of Misconduct

1. Unauthorized Arrest of a Hospitalized Defendant

According to an article published by U.S. News & World Report (October 11, 2024), titled “Wisconsin Regulators File Complaint Against Judge Who Left Court to Arrest a Hospitalized Defendant,Judge Berz abandoned her courtroom duties to personally pursue and arrest a defendant who was hospitalized.

🔹 She exceeded her judicial authority.
🔹 She violated the separation of judicial and law enforcement roles.
🔹 She compromised judicial impartiality (SCR 60.03).

This was an egregious abuse of power and a fundamental violation of human rights. The fact that this has become a pattern of misconduct raises grave concerns about her capacity to uphold justice.

2. Pattern of Substitution Requests and Loss of Confidence

Numerous attorneys have formally requested substitutions to remove Judge Berz from their cases.

🔹 Madison.com: “Substitution Requests, Ellen Berz, Dane County”
🔹 Cap Times: “Attorneys Don’t Want Dane County Judge Ellen Berz to Hear Their Cases”

The sheer volume of substitution requests suggests a total erosion of trust in her ability to preside fairly and impartially. Her continued presence on the bench is damaging public confidence in the Wisconsin judiciary.

3. Desecration and Disrespect Toward the Rastafarian Religion

Judge Berz has exhibited clear bias and hostility toward the religious practices and sacred beliefs of Rastafarians.

🔹 She ignored federal protections for Rastafarian Sacramental Cannabis use.
🔹 She criminalized a federally recognized religious practice.
🔹 She labeled Ras Jesse Schworck a “habitual cannabis user”—a direct attack on his faith. This blatant religious discrimination demonstrates an inability to remain impartial and an unlawful bias against a recognized religious group. She might as well burn the American flag and set a cross on fire, because her actions show absolute disregard for constitutional rights and religious freedom.

Public Perception & Judicial Integrity

The following reports further confirm the public scrutiny surrounding Judge Berz’s misconduct:

🔹 WISN: “The Legal Landscape: Wisconsin Judge Faces Misconduct Complaint”
🔹 Spectrum News 1: “Wisconsin Judge Complaint,” October 11, 2024
🔹 Madison.com: “Ellen Berz Judge Misconduct Complaint”

The Wisconsin Judicial Commission has already filed its own complaint against Judge Berz, yet no corrective action has been taken. She is still on the bench destroying lives, a rational person may conclude that she finds joy in her actions.

Immediate Actions Required by the Wisconsin Judicial Commission

To avoid federal intervention and full-scale public exposure, we demand that the Wisconsin Judicial Commission immediately:

✅ Initiate formal disciplinary proceedings against Judge Berz and all judicial officers complicit in religious discrimination, corruption, and constitutional violations.
✅ Immediately cease the judicial abuse of religious practitioners, including the weaponization of mental health evaluations to silence faith leaders.
✅ Conduct a full-scale internal audit into Wisconsin’s judicial misconduct, unethical rulings, and suppression of religious liberties and Cannabis users.
✅ Review and overturn wrongful convictions and unlawful rulings against Cannabis, Plant Medicine, and Entheogen users who were targeted based on their spiritual beliefs.
✅ Refer Judge Berz and all implicated judges for federal investigation, removal from the bench and criminal charges.
✅ Enforce compliance with federal mandates protecting religious liberties, ensuring that no future judicial rulings violate RFRA, the First Amendment, or Equal Protection.

The Wisconsin Judicial Commission must align with federal mandates and ensure all judges under its oversight follow the lawful protections of religious freedom outlined in:

🔗 DOJ Memo (2017)
🔗 DOJ Component Heads Memo
🔗 DOJ Religious Liberty Protection Memo

Failure to immediately address these demands will result in federal intervention, public exposure, and legal actions ensuring that every individual complicit in these violations is held accountable.

Non-Confidentiality Request

Pursuant to Wisconsin Statute § 757.93, I request that my identity NOT remain confidential and be fully disclosed to Judge Berz.

Conclusion

The integrity of the judiciary is paramount to democracy—or so they say. In reality, tyranny, persecution, and silencing dissent are still alive and well. Judge Berz isn’t an anomaly—she’s just keeping the blue line culture and traditions going, abusing power, ignoring rights, and making sure justice only serves those in control. Another enforcer of state-sponsored oppression. I trust the Commission will thoroughly investigate these allegations and take appropriate action to uphold the standards of judicial conduct in Wisconsin. Please acknowledge receipt of this complaint in writing, as required by your procedures, and keep me informed of any public filings or outcomes, consistent with confidentiality statutes.

Thank you for your attention to this serious matter.

Sincerely,

Reverend Heidi Grossman Lepp, Defender of the Faith and Sacred Ways
