Ilhan Omar’s Office Called WeedPress For Help On Federal Exemption To State Cannabis Laws!!!!

Just a brief note, but I was asked this last week by Ilhan Omar’s Congressional office for info on a bill I wrote the bill summary for in 2021 that passed the Minnesota House. Read the bill here: House File 1023. The bill was introduced by Young Americans for Liberty endorsed House Rep Jeremy Munson. Minnesota has reclassified cannabis into Schedule 3 and out of Schedule One. I emailed them the bill, posted a WeedPress article, and sent the article to the Congresswoman’s assistant. Very grateful to see 17 years of research start to make real progress!

House file 1023 (MN 2021) said in part:

I was a regional recruiter for YAL, a chapter President at two separate colleges, and worked campaigns as a door knocker for YAL candidates. I also was campaign manager for a winning House race in 2024, and managed social media and websites as well as logistics strategy and fundraising where we raised $57,000. I also helped secure endorsements. YAL endorsed lawmaker Jeremy Munson sponsored this bill.

Nice to see all this effort paying off on my singular idea to make America better: convincing lawmakers to apply for federal exemption via 21 U.S.C. 822(d)/21 CFR 1307.03, and other relevant statutes, but especially those two.

21 USC 822(d) has no application process.

 

21 USC 822(d) covers a class of activity, such as religious use of peyote.

 

21 USC 822(d) should be between a state and the federal administration, like it is between that church and the federal administration.

 

There is no application, but a state attorney general could contact the U.S. Attorney General and ask for a waiver.

You have to understand who has the higher authority, a state or a federal administrative official.

 

Most people think Congress authorized that administrative official and because of that the administrative official has the higher authority.

But, Congress did not give that administrative official authority because the authority is only to make a decision on a waiver.

 

If Congress had predetermined the outcome of that decision, then the administrative official would have the higher authority.

 

But that is not what Congress did.

 

So, the state has the higher authority.

 

The decision still might stand if it is consistent with the public health and safety, but a State is going to have a strong presumption of being the better judge of what’s best for the people.

 

So, it could end up in federal court, as it probably should, under federalism.
