605 Cannabis’s Melissa Mentele Files Appeal of May 12 TPO Denial; Court Sets Briefing Schedule

A notice of appeal has been filed by 605 Cannabis’s Melissa Mentele regarding the May 12, 2026 denial of her petition for a temporary protection order in Mentele v. Karimi (TPO 26-343). This marks the latest in a series of TPO filings by Mentele against Karimi, with multiple prior petitions in both Minnehaha and Hanson Counties having been denied following evidentiary hearings.

On May 26, 2026, the Honorable Mandi A. Mowery, Circuit Court Judge for the Second Judicial Circuit, issued an Order Setting Briefing Schedule. The order establishes the following timeline for the appeal:

• The Appellant (Melissa Mentele) shall serve and file her opening brief within 30 days after the filing of the transcript, or within thirty days after the notice of appeal if no transcript is ordered.

• The Appellee (Jason Karimi) shall serve and file a response brief within 30 days after service of the Appellant’s brief.

• The Appellant may serve and file a reply brief within 10 days after service of the Appellee’s brief.

The order states that extensions will only be granted by Order of the Court. At the time of filing briefs, the parties are required to provide a copy to the assigned judge.

The May 12, 2026 denial of the temporary protection order remains in effect unless overturned by the appellate court.

WeedPress will continue to document the public record of these proceedings as they develop. WeedPress also intends to file a petition with the South Dakota Department of Health in July regarding state scheduling issues.
