Membership reflects the 2026 Legislature; incoming 2027 members will be added after the Nov. 3 election is canvassed.
Last updated: Oct. 27, 2026.

This page lists every member of the 2026 South Dakota Legislature, all 35 senators and 70 representatives, with how each one voted on the floor on selected major cannabis bills from 2021 to 2026, most of them medical cannabis bills. Every vote comes from the official roll calls the Legislative Research Council publishes at sdlegislature.gov. Each vote in the table links to its roll call, so readers can check any entry.

How to read this

  • Yea / Nay / Excused are what the official roll call records. Each one links to that roll call.
  • No floor vote means the member served that year, but the member’s chamber did not take a floor vote on the bill.
  • Not in office means the member was not in the Legislature that session.
  • (H) or (S) after an entry shows the member’s chamber that session: after Yea, Nay or Excused, it is where the vote was recorded. Some members have served in both chambers.
  • Patient-access votes cast in favor: X of Y. Five roll-call bills are counted: HB 1100 (2021), HB 1004 (2022), SB 24 (2022), SB 191 (2024) and HB 1065 (2026). On each, a Yea vote was a vote to delay or restrict medical cannabis access, so a Nay is counted as a vote in favor of patient access. Y is the number of those bills on which the member voted Yea or Nay; X is how many of those votes were Nay. Entries marked Excused, Not in office or No floor vote are not counted.
  • SB 3 (2022, adult-use legalization) and HB 1160 (2026, repeal of the Medical Marijuana Oversight Committee) are shown for context but not counted. SB 3 was an adult-use bill, not a medical cannabis bill. HB 1160 would have changed legislative oversight rather than the rules patients follow.
  • The count is a tally, not a grade or a label. A single roll call can reflect amendments, procedure or reasons unrelated to cannabis.

The bills

HB 1100 (2021) (Counted). Would have delayed most or all of the voter-approved medical marijuana law (IM 26), depending on the version, from July 1, 2021, to Jan. 1, 2022, and created an interim committee. The House-passed version delayed the entire law; the Senate-passed version let two sections take effect on schedule, the list of unauthorized conduct and the medical-purpose defense to prosecution. The chambers passed different versions; the bill died when neither chamber adopted a conference committee report. Floor roll calls: House 40–28 (Feb. 25, 2021, do pass as amended); Senate 29–6 (March 8, 2021, do pass as amended).

HB 1004 (2022) (Counted). Would have prohibited medical cannabis cardholders from growing cannabis at home. Passed the House; deferred to the 41st legislative day in Senate Health and Human Services. Floor roll calls: House 41–29 (Jan. 24, 2022, do pass).

SB 24 (2022) (Counted). Limited home cultivation by medical cannabis cardholders; the bill changed between the two votes counted here. The Senate vote was on a version capping a cardholder at three flowering and three non-flowering plants. The House then amended the bill into a ban on home cultivation by cardholders (amendment adopted 40–29, March 2, 2022), and the House vote was on that version. The final law, allowing two flowering and two non-flowering plants, came from a conference committee report adopted March 9, 2022 (House 50–19; Senate 24–11); those conference-report votes are not counted in this scorecard. Signed by the governor March 28, 2022. Floor roll calls: Senate 30–5 (Feb. 7, 2022, do pass as amended); House 52–17 (March 2, 2022, do pass as amended).

SB 3 (2022) (Shown, not counted). Would have legalized and regulated adult-use (non-medical) marijuana. Passed the Senate 18–17. In the House, a Yea was a procedural vote to place the bill on the calendar after a committee deferred it; that motion failed. Shown for context; not a patient-access vote, so not counted. Floor roll calls: Senate 18–17 (Feb. 23, 2022, do pass as amended); House 28–40 (March 3, 2022, motion to place on calendar under Joint Rule 6F-6).

SB 191 (2024) (Counted). Restricted the use of medical cannabis by people on probation, parole or conditional release by requiring their practitioner to attest that the use is consistent with the medical standard of care and reasonable compared with other treatment options. As introduced, the bill would have allowed such individuals to be restricted to medical cannabis approved by the U.S. Food and Drug Administration; the Senate Health and Human Services Committee replaced that text with the practitioner sign-off requirement on Feb. 14, 2024, before both floor votes. Signed by the governor March 26, 2024. Floor roll calls: Senate 29–4 (Feb. 20, 2024, do pass as amended); House 63–7 (March 4, 2024, do pass as amended).

HB 1065 (2026) (Counted). Would have narrowed the medical-purpose affirmative defense in cannabis prosecutions to registered cardholders, nonresident cardholders and registered designated caregivers. Passed the House; deferred to the 41st legislative day in Senate Health and Human Services, 4–3. Floor roll calls: House 53–13 (Feb. 17, 2026, do pass as amended).

HB 1160 (2026) (Shown, not counted). Would have repealed the Legislature’s Medical Marijuana Oversight Committee. Passed the House; failed in the Senate 15–19 after being placed on the calendar. Shown for context; not counted. Floor roll calls: House 41–26 (Feb. 23, 2026, do pass); Senate 15–19 (March 9, 2026, do pass).

* Shown for context; not counted. (H) = House vote; (S) = Senate vote. Party, district and chamber are as of the 2026 session.

What this page does not include

  • Committee votes. Several bills were killed in committee, some after passing one chamber, and only a committee’s handful of members vote there. Examples: HB 1101 (2025), a repeal of medical marijuana provisions, deferred in House Health and Human Services, 7–6; SB 194 (2026), a dispensary potency cap, deferred in Senate Health and Human Services, 6–1; and HB 1065 (2026), deferred in Senate Health and Human Services, 4–3. These committee votes are not in the table.
  • 2023 and 2025. No 2025 medical cannabis bill reached a floor vote in either chamber. This edition omits 2023 floor votes on medical cannabis bills, so they are not part of the table or the tally.
  • 2027 members. Members elected Nov. 3, 2026, will be added after the State Board of Canvassers certifies the results.
  • Hemp and other bills. Hemp-derived THC, banking and appropriations bills are outside this page’s scope.
