My email request is below. I want to publish a list of what states will automatically remove schedule one, and, want to use it as a reference for ongoing court cases around the country. So, this list could be quite useful.

Do you have any insight or guidance regarding which states have this automatic schedule one removal trigger, if the feds remove schedule one? I’ve been aware a long time of these dynamics but never put together a list. Does anyone you know keep a list of this? 

I have advocated strongly for schedule one removal process now happening for 15 years and wish to publish a list of states that will automatically remove schedule one if the feds do at my blog at weedpress.wordpress.com. Any assistance would be deeply, greatly appreciated.

  1. Iowa does not have a trigger law on federal scheduling, unless it is a new federal controlled substance that has not been previously scheduled. Iowa Code 124.201.

      1. I never accused you of being a saboteur. Saboteur of what? I remember what I accused you of, but it was nothing as sinister as that. I apologize, for what I actually did say, but not for saying something I never said.

      1. For what it is worth, I’d look at the uniform act, section 201. You will probably find a section of each state law that corresponds to it, like Iowa Code 124.201. I know some states have trigger laws, but not Iowa. On the other hand, Iowa is going to schedule cannabis in whatever federal schedule it gets moved to. Iowa has no reason to say it has no medical use, so times have changed. Cannabis was recognized as having medical value in the international treaty in December of 2020, so that train has left the station.

  2. Schedule III will probably be persisted in all 50 states, although some states already have cannabis in a different schedule. What this will do is generate windfall profits for federally illegal cannabis businesses who no longer have to pay the tax penalty under 26 U.S.C. 280E. Hopefully, this will give Congress an incentive to de-schedule cannabis to prevent this unjust distribution of wealth to white collar organized crime. We shall see …
