This tracker follows cannabis-related legislation for South Dakota’s 2027 legislative session. It covers medical cannabis, hemp and hemp-derived THC, and related drug-scheduling bills. Bills will be added as they are prefiled or introduced, each with its sponsor, a plain-English summary, its status and a link to the official bill page. Until then, this page lists the key dates and the interim committee activity identified so far.

Jan. 12 is the second Tuesday of January, the day the state constitution sets for the Legislature to convene.3 The Dec. 13 prefiling date is WeedPress’s calculation, counting 30 days back from the Jan. 12 opening under SDCL 2-7-4.2

Prefiling and draft requests

Under SDCL 2-7-4, anyone elected or appointed to serve in a regular session may file bills and resolutions with the LRC during the 30 days before the session convenes. Interim committees of the LRC may also prefile.2 Draft requests for unlimited introduction are due to the LRC by 5 p.m. Jan. 26, 2027, and all draft requests are due Feb. 1. The last day to introduce individual bills is Feb. 3.1 Drafts become public only when a bill is filed, so this page will list a draft only after it is filed or a committee publishes it.

As of Oct. 27, 2026, the Legislature’s bill system does not yet list a 2027 session; the latest regular session it lists is 2026, so no 2027 prefiled bills appear there.4

Interim committee items headed to session

Medical Marijuana Oversight Committee (2026 interim). The Oct. 13 agenda lists the members as Reps. Josephine Garcia, chair, and Bobbi Andera; Sens. John Carley, vice chair, and Lauren Nelson; and nonlegislator members Francine Arneson, Julie Bostic, Kasey Entwisle, Kristi Palmer, Andrew Schock, Jon Thum and Pat West.5 The committee met Aug. 17 and Oct. 13, 2026; minutes are posted for Aug. 17, and SDPB audio is posted for Oct. 13.6, 8 As of Oct. 27, no draft bill or formal recommendation for 2027 has been posted to the committee’s record. Minutes of the Oct. 13 meeting are not yet posted, and the most recent document in the record is dated Oct. 19. No further meeting is listed.7

Unofficial: WeedPress made a machine-generated transcript of the SDPB audio of the Oct. 13 meeting. According to that unofficial transcript, the agenda’s “Committee Discussion and Directives” segment consisted of member comments, including a suggestion to create a task force, and the meeting adjourned without a vote on draft legislation. This is not an official record. WeedPress will check it against the official minutes once they are posted.8

Attorney General Official Opinion No. 26-06 (Oct. 6, 2026). Requested by MMOC members and filed as a handout at the Oct. 13 meeting. Its answer, in full: “Because current Drug Enforcement Administration (DEA) administrative rules permit state medical-marijuana facilities to continue operating with proper federal and state registration, the federal rescheduling of marijuana will likely have a negligible impact on South Dakota’s medical-marijuana program.”9

Committee-approved draft bills: none found as of Oct. 27, 2026.
