The South Dakota Legislature’s public schedule now lists a meeting of the Medical Marijuana Oversight Committee for Tuesday, October 13, 2026, at 11:00 a.m. in Room 362 at the State Capitol in Pierre.¹
For weeks the committee page showed the 2026 roster and the August materials and nothing else.²
The date is now on the same public schedule that lists the Interim Rules Review Committee for the next morning, October 14, in Room 414.³
Those are two different rooms. They do different work.
What the statute actually gives this committee
The Medical Marijuana Oversight Committee exists because Initiated Measure 26 put it in statute. The Executive Board of the Legislative Research Council appoints the members. The committee must meet at least twice a year.⁴
Its job is to evaluate the program and make recommendations to the Legislature and the Department of Health. The statute lists the subjects: patient access, whether dispensaries and cultivation facilities are serving patients, testing capacity, security safeguards, recommended revisions to chapter 34-20G or the department’s rules, research, and clinical aspects of the program. It also requires the committee to take input from patients, caregivers, pharmacists, schools, municipalities, Health, DCI, Public Safety, and establishments.⁵
That list is broad.
The power is not.
The committee does not adopt Article 44:90. It does not sign a final rule. It does not replace the Department of Health’s rulemaking file or the Interim Rules Review Committee’s review of that file. It recommends. Other desks decide.⁶
The last posted MMOC meeting was August 17, 2026. The packet on the committee page still reflects that date: a Department of Health program overview, an NCSL handout on federal cannabis and hemp implications, a guest register, and a public handout.⁷ SDPB recorded the session.⁸
The Department of Health (DOH) used that August meeting to describe the state of the program, including the growth in licensed home cultivation.⁹ Federal scheduling was discussed there as context. It was not a rule-adoption hearing.
The rule-adoption hearing was yesterday.
On September 23 the Department of Health held the public hearing on its 38-section rewrite of Article 44:90. Written comments remain open through October 3. The package then goes to the Interim Rules Review Committee on October 14.¹⁰
So the October 13 oversight meeting now sits in a tight sequence:
September 23 — Health hearing
October 3 — written-comment deadline
October 13 — MMOC, Room 362
October 14 — Interim Rules Review Committee, Room 414
That is not an accident of the calendar so much as a test of whether people can keep the proceedings straight.
Room 362 is the advisory room.
If the October 13 agenda, once posted, includes program data, patient access, establishment performance, testing capacity, or recommended statutory changes, that is inside SDCL 34-20G-93.¹¹
Room 414 the next morning is the rule-review room.
That is where DOH has to show whether it incorporated the Legislative Research Council’s September 4 recommendations on the proposed 44:90 amendments, including the legality comments on the under-21 home-cultivation restriction, or whether it is taking those recommendations to the committee for a final determination.¹²
Do not ask MMOC to do IRRC’s job.
Do not ask IRRC to pretend it is the oversight committee.
A recommendation voted in Room 362 on Tuesday does not amend 44:90:02:07 on Wednesday. A packet that survives Room 414 on Wednesday does not become a substitute for the oversight committee’s statutory duty to take patient and establishment input.
The date being posted is useful only if that distinction survives the week.
The agenda is not posted yet
As of this writing, the official listing is the meeting block: date, time, room. It is not a posted agenda with witnesses, motions, or document links for October 13.¹³
That is the next document to watch.
When the agenda appears, the questions are simple.
Is DOH on the agenda again, and if so, with what numbers.
Is the 44:90 package on the agenda as an oversight discussion, or is it being left to IRRC the next day, where it belongs as a rule packet.
Are patients, caregivers, and establishments actually on the witness list, as the statute requires the committee to seek their input.
Are motions being published in advance this time, or is the committee repeating the 2025 practice of voting recommendations the public did not see before the gavel.¹⁴
Those are process questions. They can be answered from paper once the agenda exists.
Show up for the right meeting. Bring the right document. Do not confuse a recommendation with a rule.
